Cartahaven Terms of Service
Draft, last edited October 2026
1. Navigation safety
Maps sold here are aids to navigation, not guarantees. Trails, roads, water levels, closures, hazards and land ownership change, and any map can contain errors or be out of date. GPS positions can be inaccurate, and devices fail, lose power or lose signal. You are responsible for your own safety: carry a backup map and compass, check current conditions with the land manager, and use your own judgment. Cartahaven and its publishers are not liable for injury, loss or damage from using or relying on any map.
2. Accounts
You must give accurate information and keep your password secure. You are responsible for activity on your account.
3. Buying maps
- A purchase gives you a personal, non-transferable licence to use the map for your own navigation. It does not transfer copyright.
- Purchases include future versions of the same map that the publisher releases.
- Do not redistribute, resell or publicly post maps you have bought.
- Refunds: [TO DECIDE: refund window and process].
4. Publishers
By uploading a map, the publisher represents and warrants that:
- they own the map or hold all rights and licences needed to sell and distribute it here, including rights to any base data, imagery and third-party content in it;
- the map and its listing do not infringe anyone's copyright, trademark, privacy or other rights;
- listing information (coverage, dates, descriptions) is accurate and not misleading; and
- they will indemnify Cartahaven against claims arising from a breach of these warranties. [LAWYER: indemnity scope]
Publishers grant Cartahaven a non-exclusive licence to host, display previews of, and deliver their maps to buyers. Publishers keep their copyright. Unpublishing a map stops new sales; existing buyers keep access to versions already released. [LAWYER: confirm post-termination access]
5. Fees and payouts
Payments are processed by Stripe. Cartahaven charges a platform fee of 15% of each paid sale, which includes card processing. The remainder is paid to the publisher's connected Stripe account. Publishers must accept Stripe's Connected Account Agreement and are responsible for their own taxes. [LAWYER: sales tax / VAT responsibility, marketplace facilitator rules]
6. Copyright complaints (DMCA)
If you believe a map on Cartahaven infringes your copyright, send a notice to our designated agent at support@cartahaven.com with: your contact details; the copyrighted work; the URL of the infringing listing; a statement of good-faith belief that the use is not authorised; a statement, under penalty of perjury, that the notice is accurate and you are authorised to act; and your physical or electronic signature. We will remove or disable access to the listing and notify the publisher, who may send a counter-notice. Repeat infringers will have their accounts terminated. [TODO: register a DMCA designated agent with the US Copyright Office and add a postal address.]
7. Acceptable use
No illegal content, malware, scraping, attempts to bypass payment or download protections, or abuse of other users.
8. Disclaimers and limitation of liability
The service is provided "as is" without warranties of any kind. [LAWYER: full disclaimer and liability cap]
9. Changes and contact
We may update these terms and will notify users of material changes. Questions: support@cartahaven.com. Governing law: [TO DECIDE].
